Khul Designs – Website Design Terms & Conditions

Scope of Work
Khul Designs will provide website design services as agreed upon with the client. This includes layout design, content integration, and basic functionality setup. Any additional features or custom development beyond the agreed scope may incur extra charges.

Value & Affordability Commitment
Our packages are intentionally priced to be affordable and accessible. We achieve this by leveraging a curated selection of free or semi-free tools, plugins, and resources, which allows us to minimize development expenses without compromising quality. This approach ultimately reduces costs for our clients while maintaining a high standard of design and functionality.

1. Payment Terms
   A 50% deposit is required before work begins. The remaining balance is due upon project completion.

• Payments must be made via bank transfer or other agreed-upon methods.

2. Project Timeline

• Standard website design projects take up to 7 days, provided all required materials are received on time.
• Delays caused by external registrations (e.g., Pay Portals for e-commerce), or the client (e.g., late content submission) may extend the timeline.

3. Client Responsibilities

• The client must provide all necessary content, images, and branding materials.

4. Ownership & Copyright

• Upon full payment, the client owns the final website design.
• Khul Designs retains the right to showcase the project in its portfolio & on your footer, unless otherwise agreed.

5. Hosting & Maintenance

• Domain registration is included in the package, but hosting services are separate.
• Ongoing maintenance and updates can be provided at an additional cost unless if your website is hosted by us, minor maintenance falls under your monthly fee.

6. Confidentiality & Privacy

• Client data will not be shared with third parties without consent.

7. Termination Clause

• If the client cancels after work has begun, the deposit is non-refundable.

8. Liability & Disclaimers

• Khul Designs is not responsible for third-party service failures or features (e.g. Pro Features, Pro Plugins, etc.
• The client is responsible for website content compliance with legal and industry standards.

9. SEO & Performance Disclaimer

While basic SEO setup (e.g., meta tags, mobile responsiveness) may be included, Khul Designs does not guarantee search engine rankings or traffic performance unless explicitly stated in a separate SEO service agreement.

10. Third-Party Services & Integrations

If the website integrates with third-party services (e.g., payment gateways, booking systems), Khul Designs is not liable for their performance, availability, or changes in their terms of service.

11. Content Responsibility

The client is responsible for ensuring that all content provided (text, images, videos) is original or properly licensed. Khul Designs is not liable for copyright infringement resulting from client-supplied materials.

12. Portfolio & Credit

Unless otherwise agreed, Khul Designs reserves the right to:

• Display the completed project in its portfolio.
• Include a discreet credit link in the website footer (i.e.., “Website Design by Khul Designs”)

13. Legal Compliance

The client is responsible for ensuring the website complies with local laws and regulations, including privacy policies, cookie notices, and accessibility standards, where applicable.

14. Website Handover & Ongoing Hosting Option

Upon project completion and full payment, clients have two options for website management:

1. a) Website & Hosting Handover:
   Clients may request a full handover of the website, including hosting transfer assistance. After handover, clients assume full responsibility for hosting, updates, and maintenance.
2. b) Ongoing Hosting & Support by Khul Designs (R150/month):
   Alternatively, clients may choose to keep their website hosted by Khul Designs for R150 per month. This includes:

• Monthly hosting
• Minor content edits and visual tweaks
• General website maintenance
• 24/7 support for email and website-related queries

Clients may cancel the hosting service with 30 days’ notice.
